Defensible Production and Delivery Under Rule 34 and the Federal Format Expectations
Production is where every earlier discipline (collection, processing, review, redaction, privilege) either holds up or falls apart in front of opposing counsel. The useful production leaves nothing for opposing counsel to challenge on format, on completeness, on Bates continuity or on load-file integrity. Pre-delivery QC anchored on reconciliation against the review-platform production log, not on assumption that the platform did what it was supposed to do.
What a Defensible Production Actually Delivers
- Format that matches the meet-and-confer or the requesting party’s specifications. Native, near-native, TIFF/PDF image with load file, or a mix appropriate to the content class. The specification is documented, agreed and reconciled against the delivered set.
- Continuous Bates numbering across the produced population, with family integrity preserved and no gaps that require a supplemental production to correct.
- Complete load files matching the receiving party’s target platform, with the metadata, extracted text and family-relationship fields the specification calls for.
- Redaction QC that catches the misapplied redactions, the un-flattened redactions and the missed redactions that most production defects trace back to.
- Privilege log aligned to the production, with entries that satisfy the substantive requirements of the applicable jurisdiction and the specific privilege-log format the parties have agreed to.
- Rule 502(d) clawback support where the production is issued under a clawback order, with the tracking record that supports rapid identification and re-production of any inadvertently produced privileged material.

Production Formats We Deliver
- TIFF/PDF image with load file: the traditional production format, with single-page TIFF or PDF images, extracted text, and DAT/OPT/LFP load files matching the receiving party’s target platform.
- Native production: file-native production with metadata and family relationships preserved, appropriate for spreadsheets, presentations, structured data extracts and other content that loses fidelity in image format.
- Near-native production: image production for text-heavy documents with native files preserved and cross-referenced for the specific content classes that need it (typically spreadsheets and multimedia).
- Modern-data-appropriate production: production of messaging content (Slack, Teams, WhatsApp) with thread structure and reply relationships preserved, audio and video content with transcripts and native files, and mobile content with the on-device application context appropriate to the matter.
- Structured-data production: query-based extractions with schema documentation and provenance affidavits, formatted for use by the receiving party’s expert without requiring the underlying system to be produced.
- Cross-format production: multi-part productions that combine formats appropriate to the content, with a delivery record that identifies which format applies to which portion of the production.
Bates Stamping and Family-Integrity Numbering
Bates numbering is deterministic on our productions. Continuity is verified against the production log before delivery. Family integrity (parent-child relationships across emails and their attachments, and comparable structures for modern-data content) is preserved through the numbering. Where a production is issued in multiple parts, the numbering scheme is designed at the outset to survive later supplemental productions without requiring re-numbering.
Privilege Log Preparation
Privilege log entries are prepared alongside the production, not as an afterthought. Each entry contains the substantive elements the applicable jurisdiction requires (date, author, recipients, subject-matter description, privilege claim basis) in a format that satisfies both the letter and the spirit of the meet-and-confer agreement. Categorical privilege logging is supported where the parties have agreed to it and where the applicable authority permits it. Redaction Application and Redaction QC
Redactions are applied under senior-reviewer discretion, flattened into the image where the production format requires it (so the underlying content cannot be recovered through PDF-layer manipulation), and reviewed pre-delivery against the marked-for-redaction population to catch misapplied and missed redactions. Redaction logs are produced alongside the production where the specification calls for them, or where the matter’s posture makes explicit redaction accounting the safer choice.
Where Production Actually Runs
Production runs on whichever platform the review took place in. CompleteDiscovery produces load files and Bates-stamped image sets natively; Relativity, Reveal and Nuix each produce their own; our production QC discipline is the same either way. Where the matter blends structured data and traditional documents, the production is coordinated across both surfaces so the receiving party sees one coherent set.
Rule 502(d) Clawback and Inadvertent-Production Support
Productions issued under a Rule 502(d) clawback order carry the tracking record needed to rapidly identify, re-produce and confirm receipt of any inadvertently produced privileged material. The tracking includes the specific documents recalled, the receiving-party acknowledgements, and the timing record that supports the operator’s good-faith position on the recall. Where the matter is on a heightened clawback posture (e.g. under a specific Rule 502(d) order with tight response windows), the production is designed to make recall as fast as possible if it becomes necessary.
